Privacy Notice - Local Plan
Why we collect information about you
Kettering Borough Council collects and processes your personal data in order to discharge its statutory functions under the Planning Policy Service and in the preparation of a Local Plan for the Borough. Your information is required to ensure we maintain accurate records, and that you can be properly involved in the preparation of the Local Plan, including being invited to the Public Examination into the Plan.
How will we use the information we hold about you?
The categories of information we collect to administer and carry out tasks associated with the Local Plan are:
- Contact details, eg. telephone numbers, email address
- Business or organisation details
- Agent Details
- Comments – which may contain other identifiable data including special category data
Your information may be supplied to us directly by you when responding to a planning policy or Local Plan consultation, or when you request to be added to the Planning Policy or Local Plan mailing list.
We will use your information to notify you of any Planning Policy activity including the Local Plan and to invite you to take part in any Public Examination.
Due to the Covid-19 Pandemic, it is possible the Local Plan Examination will be held as a virtual hearing.
When video conferencing using applications such as Zoom, Microsoft Teams, or your name, username, email address, your computer’s IP address, MAC address and device name may be collected by the companies who own these applications. A live stream of the hearing will be hosted via YouTube , during this time, your image and name will appear on a publicly accessible platform. If you not a participant but are viewing the meeting via YouTube, information such as your device details and identifiers may be collected. Please refer to the relevant Privacy Notices for the relevant applications.
What is the basis for us to process your data?
The Council processes your data in this way under the following lawful bases which are supported in law:
- The performance of a task carried out in the Public Interest
- Necessity for compliance with a legal obligation to which the Council is subject
The relevant legislation which supports this processing is:
- The Planning & Compulsory Purchase Act 2004 (as amended)
- The Town & Country (Local Planning) (England) Regulations 2012

Who we will share your information with
Your information will be shared with the Examination Programme Officer (who is responsible to the appointed Planning Inspector) who will only use your data to make contact with you regarding the Local Plan Examination.
The Planning Inspectorate will hold the Public Examination on behalf of the Minister of State for Housing, Communities and Local Government (MHCLG).
Any response to a consultation regarding the Local Plan is shared in full with the Planning Inspectorate, to include names and addresses as well as comments. Location details and comments of contributors are made public however exact addresses and contact information are redacted or withheld from public view, except where addresses form part of the comments made.
We may share your personal information if there is a public interest to do so, or the law allows it, such as the prevention and / or detection of crime. This could include the need to disclose sensitive or confidential information such as medical details to other organisations.
How long do we keep your records?
We will only keep your information for the minimum period necessary and in line with our Corporate Retention Schedule. Information will be securely destroyed when no longer needed.
Audio and/or video recordings will be retained for a maximum of 3 months.
