Broughton Neighbourhood Plan and Neighbourhood Development Order

Following a Referendum on Thursday 20 September on the Broughton Neighbourhood Plan and Broughton Neighbourhood Development Order, a report was presented to Executive Committee on 17 October 2018. This sought agreement to “Make” these documents, formally adopting these as part of the Development Plan for Kettering Borough. This followed a ‘Yes’ vote of 95% for the Neighbourhood Plan, and ‘Yes’ from 93% for the Neighbourhood Development Order. Members agreed to both the Broughton Neighbourhood Plan and the Broughton Neighbourhood Development Order being Made.

In accordance with Regulation 19 (a) of the Neighbourhood Planning Regulations 2012 (as amended) and Section 38A (4) of the Planning and Compulsory Purchase Act, please find a decision statement for the Broughton Neighbourhood Plan below:

Referendum

On Thursday 20 September a referendum will be held relating to the adoption of the Broughton Neighbourhood Plan and the Broughton Neighbourhood Development Order.

The question that will be asked in relation to the Broughton Neighbourhood Plan is as follows:

‘Do you want Kettering Borough Council to use the Neighbourhood Plan for Broughton Parish to help it decide planning applications in the neighbourhood area?’

The question that will be asked in relation to the Broughton Neighbourhood Development Order is as follows:

‘Do you want the type of development in the Neighbourhood Development Order for Broughton Parish to have planning permission?’

Regulation 18 and Regulation 25 Notices

These notices are the decisions statements required to be prepared under Regulations 18(2) and 25 (2) of the Neighbourhood Plan Regulations 2012 (as amended). The notices set out the Council’s responses to the recommendations in the Broughton Neighbourhood Plan Examiners Report and the Broughton Neighbourhood Development Order (NDO) Independent Examiners Report in accordance with regulations 18 and 25 of the Neighbourhood Planning Regulations 2012 (as amended).  The Neighbourhood Plan and Neighbourhood Development Order will now proceed to referendum.

Regulation 16 & 23 Publicity (post submission)

The Broughton Neighbourhood Plan and Broughton Neighbourhood Development Order were submitted to the Council on the 29th September 2017. The Plan and Neighbourhood Development Order were subject to a legal requirements check to ensure that they comply with the relevant provisions of the Town and Country Planning Act 1990 and the Planning and Compulsory Purchase Act 2004. In accordance with regulation 16 and 23, the plan and order proposals were made available for comment. A 6 week consultation took place from Monday 16th October 2017 to Monday 27th November 2017. Copies of the plan proposal and accompanying documents are available to view below. A hard copy of the Neighbourhood Plan was also available to view at the following locations:

  • Kettering Borough Council, Municipal Offices, Bowling Green Road, Kettering (8.30am - 5pm)

The consultation has now closed.

Representations made will be sent to the Neighbourhood Plan examiner who will consider whether the Neighbourhood Plan and Neighbourhood Development Order meet certain legal requirements, known as the ‘basic conditions’.

Comments were sought as to whether or not the plan and order proposals fulfil the “basic conditions”

Any representations may include a request to be notified of the local planning authority’s decision under Regulation 19 (decision on a plan proposal) in relation to the neighbourhood plan and Regulation 26 (decision on an order proposal) in relation to the neighbourhood development order.

Information

Town and Country Planning (General) Neighbourhood Planning Regulations 2012 and the Localism Act 2011

Kettering Borough Council received an application from Broughton Parish Council as a relevant body to designate the Parish of Broughton as the Neighbourhood Plan Area for the Broughton Neighbourhood Plan.  A consultation on the proposed Neighbourhood Plan Area took place from 4th November 2013 to 16th December 2013.

On 15th January 2014 Kettering Borough Council designated the Parish of Broughton as the Neighbourhood Plan Area for the Broughton Neighbourhood Plan.  A copy of the Committee Report is available to view.
