Charging Order

If a Liability Order is granted for a debt of over £1,000, the Council can apply to the County Court to have a charge put on the debtor’s property (house or land).

The court can place a charging order on your property so that when the property is sold you will have to pay that debt off first before any of the proceeds are given to you.

In some cases the Council will subsequently request an order for sale, if that is deemed to be the most appropriate method of collecting the debt outstanding. 

The order must be secured against the same property to which the liability order has already been obtained for the outstanding debt.
