Summons for Non-Payment
After the right to pay by instalments has been lost, our Recovery Team will start proceedings to apply to the Magistrates' Court for a liability order covering the debt outstanding.
A complaint is made to the court and summons for a liability order court hearing are issued to those listed on the complaint. £130 summons costs are incurred at this stage and added to the debt. The Council issues summons every month at least 14 days in advance of the court hearing date.
The summons require the debtor to appear at court if disputing their liability to pay the Council Tax, to show good reason why a liability order should not be made.
If the person does not attend, proceedings will continue in their absence.
