Land known locally as Kennel Field, situated to the North East of Harborough Road, Dingley, Market Harborough, Leicestershire. The Ordnance Survey Plan Reference is SP7787. Title number NN72770. Field used for private use. Dingley Parish Council. 9 March 2015

a) The Council is not satisfied on the information provided that Section 88(1)(a) of the Localism Act 2011 is satisfied as the nomination does not provide sufficient evidence to show that the principle use of the land that is not ancillary’ furthers or has recently furthered the local community’s social well-being or social interests.

b) The primary current use of the land by the owner is as a field which forms part of the land holding used for private use. There is no public access to the field.

c) Access to the land by the community has been limited and by agreement with the owner for specific events and is considered as an ancillary use. 

Land known locally as the Rockingham Road Stadium and Football Ground, situated on Rockingham Road, Kettering. Title numbers: 
NN70636 and NN71742. 
 
Previous site of the Kettering Town Football Club (Stadium and Ground). Now disused and in a dilapidated state. Asset is not accessible for public use. KTFC Community CIC 1 June 2016 a) The Council is not satisfied that the conditions of Section 88(1) of the Localism Act 2011 are met on the grounds that the nomination fails to provide any evidence to show that there is a current use of the land that furthers the local community’s social well-being or social interests.

b) The nomination acknowledges that the football ground was closed in 2011 and there is no information provided to suggest that there is any current public use, or any other use, that furthers the social wellbeing or social interests of the local community.

c) It is submitted by the land owner that the property was closed in December 2011 and stripped of its fixtures and fittings in 2013 and has remained vacant and in a dilapidated state to the present day. The Council’s own enquiries have confirmed that this is correct and that there is no public access to the site.

Section 88(2) - User in the recent past

d) As there is no actual current use of the nominated property the Council is required to determine if the conditions set out in Section 88(2) are satisfied. The conditions are:
  • That there was a time in the recent past when the actual use furthered community benefit that was not an ancillary use and
     
  • It is realistic to think that there is a time in the next five years when there could be use of the land which will further (whether or not in the same way as before) the social wellbeing or interests of the community.
e) There is no statutory definition of “recent past”. The Council has taken into account the information provided and concluded that the five year period since the stadium was used as a football club was sufficient to exclude it from consideration under S88(2)(a) for the reasons stated below.

f)The Rockingham Road Stadium was the home ground of Kettering Town Football Club until the lease expired in December 2011. Access to the land by the public has been restricted and/or prohibited since December 2011.

g)Kettering Town Football Club has relocated on more than one occasion and currently has its home ground at Latimer Park, Burton Latimer. The Council understands that discussions are being held with the landowner to take on a new long term lease of Latimer Park. The role of the football club in the community continues at the new ground. The link with the Rockingham Road Stadium as its home ground has not, in the opinion of the Council, been maintained in the recent past for the purposes of S88(2)(a) of the Localism Act 2011.

h) The nomination fails to provide any evidence that there is a realistic prospect of non-ancillary future use over the next five years in accordance with S88(2)(b). It is submitted by the land owner that the property has been marketed on the open market and was open to offers for use as a stadium or alternative uses and that KTFC Community submitted a bid which was significantly lower that the value of the property as a stadium or other development value. There has been no other interest in purchasing the site for community use. The property continues to be marketed for redevelopment.

i) The property is identified in the Council’s Local Development Plan as a site for residential development. The owner is therefore in a position to sell the land for alternative uses and prevent any further community use.

j) The nomination fails to provide any clear evidence of community support for maintaining the site for community use or the financial means by which that could achieved.

The Council is in the process of applying to the Land Registry for an entry of a restriction in respect of the listed land shown in the table above.

(ii) Has the Local Authority received a notice of disposal?
The Local Authority has not received a notice of disposal in respect of the listed land.  One of the assets listed above was already for sale when the asset was listed and the nominating body was aware of this fact – see updates column in the table above.

(iii) Has any community interest group requested to be treated as a bidder?
At the moment the Council has not been notified of any intention to dispose of listed assets therefore there are no opportunities for bidders under The Act.
