Council prosecutes for fly-tipping

Following a Court hearing at Northampton Magistrates Court on 7th March 2017, a Kettering resident has been ordered to pay a total of £1480.20 for failure to control his waste after fly-tipping.

In August 2016, a Council Environmental Warden received a complaint of fly tipping at AM Labels Ltd on the Telford Way Industrial Estate. The fly tip consisted of 2 sofas, a Moses basket, a wooden chair and some other household items. 

After investigation by the Council’s team of Environmental Wardens using CCTV footage from AM Labels Ltd and the adjoining company Fasten-It the vehicle used was traced back to a domestic property in Kettering.

At the Court hearing the resident pleaded guilty to the following offences:

1. Failure as a carrier of controlled waste to such measures as were reasonable in the circumstances to prevent the escape of controlled waste from your control CONTRARY to section 34 (1) (b) and (6) of the Environmental Protection Act 1990.

2. Transporting controlled waste in the course of business or otherwise with a view to profit without being a registered carrier of controlled waste CONTRARY to section 1 (1) of the Control of Pollution (Amendment) Act 1989.

He was fined £300 (broken down into £150 per offence) and ordered to pay costs of £1150.20 and a victim surcharge of £30.

Kettering Borough Council advises all residents of the importance of disposing of waste correctly through a licensed waste carrier, though the Council’s Bulky Waste Collection Service, or at the Household Waste Recycling Centre. The register of waste carriers can be found in the Environment Agency Website (www.environment-agency.gov.uk), and householders can book bulky waste collections with our Customer Services Centre by calling 01536 410 333.

Shirley Plenderleith, Head of Public Services at Kettering Borough Council, said: 

“We would always encourage residents to make use of the various legitimate ways of disposing of their waste as fly tipping is unsightly and spoils the local environment for everyone. Where possible we will seek to take action against irresponsible people.”
