Under the Public Health (Control of Disease) Act 1984, the council is under a statutory obligation to make arrangements under the above legislation for the funeral or cremation of the body of any person who has died or been found dead within the Borough where it is established after investigation that there is no possibility of alternative action.

If the next of kin is in receipt of the following, then they may be entitled to help with payments from the Social Fund;

  • Income Support
  • Job Seekers Allowance (income based)
  • Housing Benefit
  • Council Tax Benefit
  • Disabled Persons Tax Credit
  • Working Families Tax Credit

They will be able to arrange an interview for you or they can send you the claim form SF200 "Assistance with Funeral Payments".

Your Welfare Rights Officer may also be able to provide help and advice.

It is the duty of the Council to choose to bury or cremate anyone who has died or been found dead within their area.

This does not apply if a person died while being an in patient at a hospital.

The funeral arrangements would then be the responsibility of the Health Authority unless the Social Services Department has been involved with Court of Protection of the deceased person.

The Council is obliged to recover from the estate of the deceased person or from any person being responsible for maintaining the deceased prior to death any expenses incurred in making and implementing the funeral arrangements.

The Council has no powers to accept responsibility after private funeral arrangements have been made.
